Raids: Florida SWAT Team Kills Bartender in His Bedroom in
Predawn Drug Raid -- Two Ounces of Marijuana Seized 8/12/05 http://stopthedrugwar.org/chronicle/399/swat.shtml Two members of a Sunset, Florida, SWAT team shot and killed a 23-year-old bartender after he fled to his bedroom and picked up a pistol as his door came crashing in and masked, armed men flooded into his home during a 6:00am raid last Friday morning. Armed with a search warrant alleging drug activity at the home of Anthony Diotaiuto, police announced their take this week: two ounces of pot, some plastic baggies, and a set of scales. Police told reporters the day of the shooting they knew Diotaiuto has a license to possess a weapon, so they sent in the SWAT team to lessen the possibility of violence. They did not explain why they thought a surprise attack on the home of an unsuspecting but presumably armed man would produce a nonviolent result -- and it didn't. According to Sunset Police Lt. Robert Voss as reported in the Ft. Lauderdale Sun-Sentinel, the SWAT team knocked on Diotaiuto's door and "announced their presence" before smashing down his door. Voss said police found the victim in his living room and ordered him to "freeze," but he instead fled to his bedroom and "armed himself" with a handgun, whereupon Officers Sean Visners and Andre Bruna unloaded on him. The Broward County medical examiner reported 10 bullet wounds in his head, chest, torso, and limbs. But next-door neighbor Rudy Strauss told the Sun-Sentinel he and his wife were awake when the raid occurred and heard the crash of Diotauito's door being smashed in, but heard no yelling announcing the presence of police. There were no words spoken outside, he said, adding that he and his wife watched the raid unfold from their window. "I heard this loud bang, and I saw a flash," Strauss said Tuesday. "I never heard them say 'Police.' If somebody were pounding on the door, I would definitely hear that, or if they yelled, 'Police, police!'" Friends, family members, neighbors and supporters of Diotaiuto reacted angrily and bitterly. ""Nothing adds up," Brian Kickbush, boyfriend of Diotaiuto's mother, Marlene Whittier, said during the visitation at Fred Hunter Funeral Home in nearby Davies. "If they announced themselves, I guess all the neighbors are all liars." "My son was so frightened by black masks busting his door down in the darkness after he was asleep for one hour," said a distraught Whittier, during a wake held for her only son Tuesday night. "Now what human being in their right mind would not run?" The anger spilled over into a Sunset city council meeting Tuesday night as at least 15 people wearing black armbands demanded answers and actions. "Sunset Beach police are murderers, cowards, trigger-happy, and more," one friend of Diotaiuto's yelled at stone-faced council members in footage captured by WB39-TV. When one council responded that the council too was upset, he retorted, "If you're that upset, do something about it!" "Do two ounces of marijuana constitute a death warrant?" Sunrise resident William de Larm, a friend of Diotaiuto's, demanded of the city officials. Police were too aggressive and showed poor judgment, he said, adding that the killing made him "ashamed" to live in Sunset. Mayor Steve Feren and council members declined to address the charges and complaints about police conduct directly, saying the matter was under investigation. Two investigations are underway, by the department and by the Broward County District Attorney's office. Friends and family members described Diotaiuto as a hard-working young man who held down two jobs, attended church regularly, and had recently bought the home he was killed in. "They killed an innocent person," said Charlie Steeves, who said he was Diotaiuto's best friend. "He didn't sell drugs. He worked two jobs to buy that house." Diotaiuto's boss at the Carolina Ale House in Weston, David Arker, said his friend and employee only smoked marijuana "casually," did not sell drugs and was a hard worker. Diotaiuto's girlfriend, Leslie Kellner, 21, told the Miami Herald he worked a second job as a DJ and had sold his prized sports car to pay for the home he shared with his mother. "If he was a drug dealer, he could have bought his mom a new car, but he couldn't even afford to fix it," said Kellner, 21. |

Northern California's Mendocino County has been known for marijuana growing for at least 30 years. Part of the state's legendary Emerald Triangle of high-grade pot production along with neighboring Humboldt and Trinity counties, Mendocino has long profited from the underground economy. Last week, a local newspaper, the Willits News, tried to gauge just how large the profits may be, and the result is startling.
According to the News, the local marijuana industry will add $1.5 billion to the county's economy this year. With Mendocino's legal economy estimated at about $2.3 billion, that means the pot economy is almost two-thirds as large as all other legal economic activities combined. When combining the aboveground and underground economies, the marijuana industry is responsible for roughly 40% of all Mendocino County economic activity, a figure approaching the proportions of the Afghan opium economy.
As the News is quick to acknowledge, because marijuana is an illicit commodity, no one really knows how big the industry in the county is, so the paper relied on extrapolations based on the number of plants seized and on information it acquired about current wholesale (pound level and up) marijuana prices in the area. The County of Mendocino Marijuana Eradication Team (COMMET) seized 144,000 plants this year, and District Attorney told the paper COMMET normally seized between five and eight percent of the crop, a little less than the 10% rule of thumb for estimating all drug seizures. The paper more than compensated for the lowball seizure rate by also factoring in a 20% crop loss to spoilage. Following the formula, the News estimated 1.8 million plants were sown in the county this year, with 1.32 million surviving droughts, floods, bugs, mold, and cops.
And while both the DEA and Mendocino County law enforcement like to say that one plant produces one pound, the newspaper consulted local grower "Dionysius Greenbud," who said the average yield is closer to a half pound -- a very rough estimate, given a local crop that consists of both high-yielding outdoor plants and smaller, lower-yielding indoor plants. The paper's in-the-ballpark estimate for total pot production in the county is thus some 662,000 pounds.
The paper assumed a wholesale price of $2200 a pound, based on reports from local growers, and a simple multiplication yields a total of $1.5 billion.
Is that figure out of line? It's hard to say. In last year's "Reefer Madness: Sex, Drugs, and Cheap Labor in the American Black Market," Eric Schlosser quoted former DEA officials as estimating the value of all marijuana grown nationwide at $25 billion. While it is difficult to believe that one California county accounts for nearly 5% of all pot grown in the US, who is to say different?

The crop is illegal; there are no crop reports, and production and sales records are not collected and authenticated by the county. For that reason most of the people contacted by this writer were unwilling or unable to speculate on the dollar size of it. Agriculture Commissioner Dave Bengston, Economic Development and Finance Corporation Director Madeline Holtkamp and Bank of Willits President Richard Willoughby were not able to even hazard a guess. Sheriffs Office Sergeant Rusty Noe, commander of the County of Mendocino Marijuana Eradication Team (COMMET), also declined to give an opinion. That would be impossible to answer, said Noe. Between the illegal growing, both outdoor and indoor, and the medical marijuana, both outdoor and indoor, it would be impossible to estimate. Third District Supervisor Hal Wagenet, however, indicated a rough estimate could be made by making a few simple, back-of-the-envelope calculations. Wagenet arrived at a working number based on the number of plants seized by COMMET, which, according to Noe, is 144,000 marijuana plants for 2005. (Last year, he said, police seized about 92,000 plants. Plant seizures this year are up 56.5 percent over the 2004 figure.) In calculating the size of the countys marijuana industry, The Willits News used Wagenets formula. However some of the figures were revised and our assumptions differed slightly from Wagenets. According to District Attorney Norman Vroman, COMMET normally seizes between five and eight percent of the total crop grown in the county. We used that number instead of Wagenets 10 percent. We also thought it reasonable to include a spoilage figure of 20 percent, since nothing in agriculture is perfect. The only unknown in this equation is plant yield. Traditionally, Mendocino County law enforcement has estimated plant production at one pound of pot per plant. But according to grower Dionysius Greenbud--not his real name--the average dope plant yields about half a pound of grass. Greenbud cautioned, however, that number too is a rough estimate. I think an estimate of a pound per plant is high, he said. I usually get around a quarter pound a plant. But I was talking to a friend of mine who told me that he has these huge monster plants that give him about eight pounds a plant. So maybe a half a pound a plant is a little light. Former Third District Supervisor John Pinches agreed that an estimate of a pound of marketable marijuana per pot plant may be a little high. We decided to use the half a pound per plant figure, while admitting that our numbers are rough. The last element in the equation is the dollar value of the marijuana. According to Greenbud, the wholesale price of marijuana has been plummeting in recent years. In 1995, the wholesale price was $5000 a pound, Greenbud said. By 1999, it was $3500 a pound. Last year, in Willits it was down to $2500 a pound. The signs are showing that it is going to be less this year. It is looking like it might be $2200 a pound. Assuming a COMMET seizure rate of 8 percent, 1.8 million marijuana plants were grown in this county this year. Twenty percent were lost to spoilage, and eight percent were grabbed by law enforcement. That leaves 1,324,800 pot plants which produced an average of half a pound of pot per plant, yielding 662,400 pounds of cannibis. Assuming a wholesale price of $2200 per pound, this years harvest should yield a profit of $1.5 billion. A higher estimate would be reasonable if one assumes that some of crop is sold for a higher retail price, or if one assumes a higher yield than half a pound per plant, or both. By comparison, in 2004, raw timber brought an income of $66.6 million to timber producers and wine grapes brought in $60.1 million to grape growers. Marijuana, therefore, is at least 12 times larger than wine grapes and timber together. Richard Willoughby said that he did not know to what extent the marijuana economy penetrated the legal economy. He said growers were wary of depositing their money in local banks, because federal law requires banks file cash transaction reports for every deposit over $10,000. He also said that, based on the financial records of the three Willits banks (Bank of Willits, North Valley Bank and Washington Mutual) there was only about $125 million on deposit between the three institutions If you assume a marijuana economy of billions of dollars a year, to have $125 million on deposit isnt very much, he said. Proposition 215 legalized medical cannabis through the state initiative process, and therefore any changes to its content would require another initiative to be passed by California voters. This requirement is to prevent individuals from changing this law for their own special interests. It means that Senate Bill 420 is illegal and unconstitutional, as are any other rules made by our officials on this matter.
The people voted on medical cannabis, and our government officials are now trying to make it illegal by creating new rules that have not been approved by the people of California.
The district attorney and law enforcement are supposed to serve the people who voted for the laws. It is obvious that our public servants are not following the law or the public's best interest when it comes to medical cannabis.
